  1. Will I be able to get my case dismissed because I was not read my rights?

    Probably not. But if you were interrogated after being placed in custody, your statements can not be used against you.

  2. Will I go to jail?

    Yes, a DUI carries a maximum penalty of 12 months in jail and a minimum period of 24 hours in jail. DUI has become a very serious issue, and most judges can give jail time for even a first offense. Most judges will look at a lifetime record. Even though the law only has specific penalties for DUIs within a five year period, it is not uncommon for a Judge to look outside that window to determine a sentence. An experienced attorney may be able to keep you out.

  3. I had two alcohol offenses when I was younger. What will happen to my license if I have a third conviction?

    If the offenses took place within the last five years, you will lose your license for five years. You may be eligible for a work permit after two years.

  4. How many hours of alcohol classes will I have to take?

    In order to get your license back on any DUI, there will be a twenty hour DUI school. In addition on a second or third offense within a five year period, you will be required to attend a seventeen week Department of Human Resource course.


  5. What will happen if I do not complete the classes or public service ordered by the Court?

    Your probation will be revoked and you will go to jail.

  6. I lost my Georgia license. May I obtain a license in another state.

    In most cases, no.

  7. If I obtain an international driver's license, may I drive in Georgia, even though my Georgia license is revoked?

    No.

  8. Am I a bad person, because I was arrested for DUI?

    No, in Georgia it is not illegal to drink and drive. It is only illegal to drink and drive at the point in which you are 'less safe.' This is a pretty difficult standard for anybody to recognize.

  9. What if I burped within twenty minutes of blowing?

    The breath machine may have read alcohol from your stomach rather than you lungs. The result may be incorrect. A similar problem occurs with dentures. We own the breath machine that you took your test on. We have experts that we can use to testify about deficiencies in Georgia's breath testing system.
